Case 2: FBI investigation of Industrial Chemicals, Inc. for possible criminal violation of RCRA

Someone had contacted the state to complain of improper disposal of a hazardous waste in a solid waste dumpster and release into the soil.  The state investigated the facility the following day and found violations of state and federal regulations.  The state investigator referred the case to the EPA and FBI for possible criminal violations of RCRA.

Counsel retained Mr. Caputo to assist in an internal investigation of the situation, prepare counsel for interviews with employees and advise management.

The FBI investigation found no criminal intent on the part of the company or any individuals.
