Case 4: Confidential Client, Health Impacts and Diminishment of Property Values

Counsels for the defendants retained Mr. Caputo as their consulting expert to assist in preparing the technical aspects of the defense.  It was alleged that permitted and upset condition air emissions, along with soil and groundwater contamination had impacted the health of low income residences near three manufacturing facilities in East Texas.  Mr. Caputo has reviewed the plaintiffs’ experts and postulated on the possible arguments that they will make on behalf of the plaintiffs.  He and his staff reviewed and analyzed over 20 years of data from the client and public files at local, county, state and federal agencies contained in over 300 boxes.  Based on this analysis, Mr. Caputo proposed defenses to be pursued by the defense attorneys.  Mr. Caputo also coordinated the testifying experts and assisted in obtaining the information they needed as they prepared to testify.

Mr. Caputo also assisted counsel in preparing for and participated in the deposition of plaintiff’s experts.
