Case 8: Ali Gazah, et al v. Eliseo Abad et al

Counsel for a restaurant and apartment building retained Mr. Caputo to evaluate the merits of bringing suit against the owner/operator of an adjoining service station that had several leaking underground storage tanks.  After evaluating the data on soil, groundwater and vapor phase contamination, Mr. Caputo noted significant deficiencies in the service station’s investigation.  This was brought to the attention of the TNRCC LPST project manager who ordered the service station to expand their investigation into impacts on the soil and groundwater underlying the client’s property. 

Mr. Caputo advised counsel on questions to ask each of the defendants being deposed and assisted in evaluating the impact of the defendants’ testimony on the client’s case.
 
The defendant agreed to settle before the case was brought to trial.
