Case 9: The United States Environmental Protection Agency v. Hudson Oil & Refining Company

Counsel for the trustee in bankruptcy for Hudson Oil & Refining Company retained Mr. Caputo to negotiate with the state of Oklahoma and the EPA technical issues associated with a RCRA Facility Investigation (“RFI”) and ultimately the first corrective action under 3008(h) and 3004(u).

Mr. Caputo advised counsel on the technical issues in the case.  Mr. Caputo assisted counsel in preparing for the deposition of EPA’s lead witness and participated in the deposition.

After reviewing the historic operations of the refinery, he developed, negotiated and completed an RFI of the refinery.  He led the team that then convinced EPA that a risk based clean up was the most cost effective approach to dealing with the contamination at the site.  The team under his direction then completed the first RCRA 3008(h) and 3004(u) corrective action in the US.
